Welcome to Heirloy. These Terms of Service ("Terms") govern your use of our website, products, and services. By using Heirloy, you agree to these Terms.
1. Overview of Services
Heirloy provides a conversational storytelling platform that helps families capture and preserve life stories through automated daily questions sent via WhatsApp or SMS. Our services include:
- 30-day storytelling journey with daily prompts
- Voice note and text message collection
- Story compilation into digital formats (PDF, video)
- Optional printed hardcover book fulfillment
- Digital story hosting and sharing
2. User Accounts
To use Heirloy, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.
3. Storyteller Consent
When you purchase a story session for another person (the "Storyteller"), you represent that:
- You have the Storyteller's permission to share their contact information with us
- The Storyteller will receive a consent request before any questions are sent
- The Storyteller can decline participation at any time
- You will respect the Storyteller's decision if they choose not to participate
We will not send messages to any Storyteller who has not explicitly consented to participate.
4. Content Ownership and Responsibility
Your Content
The stories, memories, photos, and other content provided by you or the Storyteller ("User Content") remain your property. By using our service, you grant Heirloy a limited license to:
- Store and process User Content to provide the service
- Create the story outputs (PDF, video, printed book)
- Display User Content to authorized family members
We will not sell, share, or use User Content for any purpose other than providing the services you've requested.
Your Responsibility for Content
You are solely responsible for the content you and your Storyteller share through Heirloy. You should not upload or share any of the following:
- Financial information such as bank account numbers, credit card numbers, or PINs
- Government-issued identification numbers (Social Security, passport, etc.)
- Passwords, security codes, or authentication credentials
- Medical records or sensitive health information you wish to keep private
- Legal documents or information subject to attorney-client privilege
- Any content that is illegal, defamatory, or infringes on the rights of others
Heirloy is not responsible for any private, sensitive, or confidential information that you or your Storyteller voluntarily share through the platform. While we take reasonable security measures to protect your data, you assume responsibility for the content you choose to include in your story.
Story Privacy
All stories are private by default. We do not read, review, browse, or manually access your story content. Stories are processed by automated AI systems only. No Heirloy employee views your stories unless you specifically request support assistance.
If you generate a shareable story link, only people you share the link with can access the story. Shared story links are not listed on our website, not indexed by search engines, and cannot be discovered by browsing or guessing. You are responsible for controlling who you share your story link with. Once someone has your link, they can view the story without an account.
Our Content
The Heirloy platform, including our questions, AI models, design, and technology, is owned by Heirloy and protected by intellectual property laws.
5. Payments and Refunds
Pricing
Our plans are priced as one-time payments. Prices are displayed in USD and are subject to change without notice.
Refund Policy
- Before session starts: Full refund if the Storyteller declines consent
- Within first 7 days: Full refund if fewer than 5 responses have been collected
- After 7 days: Partial refund (50%) if fewer than 15 responses have been collected
- Printed books: No refunds once printing has begun

6. Prohibited Uses
You agree not to:
- Use Heirloy for any unlawful purpose
- Harass, abuse, or harm another person through our platform
- Impersonate any person or entity
- Interfere with or disrupt our services
- Attempt to gain unauthorized access to our systems
- Use automated systems to access our services without permission
- Submit false or misleading information
7. Privacy
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.
8. Third-Party Services
Heirloy uses third-party services including:
- WhatsApp Business API for messaging
- Twilio for SMS and voice calls
- Sola for payment processing
- Microsoft Azure for cloud hosting
Your use of these services is subject to their respective terms and privacy policies.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEIRLOY AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
Without limiting the foregoing, Heirloy is not responsible for:
- Any private, sensitive, or confidential information that you or your Storyteller choose to share through the platform
- Any consequences arising from content you share or make accessible through shared story links
- The accuracy, completeness, or appropriateness of AI-generated questions or story compilations
- Any loss or unauthorized access to content you share via your story link with third parties
Our total liability for any claim arising from these Terms shall not exceed the amount you paid to Heirloy in the twelve months preceding the claim.
10. Disclaimer of Warranties
HEIRLOY IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that the service will be uninterrupted, secure, or error-free.
11. Changes to Terms
We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date.
Your continued use of Heirloy after changes constitutes acceptance of the new Terms.
12. Termination
We may terminate or suspend your account at any time for violations of these Terms. You may cancel your account at any time by contacting us.
Upon termination, your right to use the service will cease immediately. Content stored on our platform may be deleted after a reasonable period.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
